NOTICE OF PUBLIC SALE

Notice is hereby given that on December 18, 2013 the Board of Education of Atwood-Hammond Community Unit School District No. 39, Piatt County, Illinois (hereinafter “District”) will sell at public sale by taking sealed bids which shall be accepted until 10:00 a.m. on January 29, 2014 at 222 W. Magnolia, Atwood, IL and which sealed bids will be opened at 10:05 a.m. on January 29, 2014 the following described property (“Property”):
A part of the Southeast Quarter (SE 1/4) of the Southeast Quarter (SE 1/4) of Section 25, Township 16 North, Range 6 East of the 3rd Principal Meridian, Piatt County, Illinois, described as follows: Commencing at a metal disk in pavement that marks the southeast corner of that Section 25; thence North 89 degrees 39 minutes 14 seconds West (bearing based on grid meridian, Illinois Plane Coordinate System, East Zone, NAD 83) 415.50 feet along the south line of the SE 1/4 of that Section 25 to the point of beginning being a point that is South 00 degrees 50 minutes 23 seconds West 40.00 feet from a 1/2” iron rod with plastic cap stamped PLS 2054; thence North 00 degrees 50 minutes 23 seconds East 335.00 feet to a 1/2” iron rod with plastic cap stamped PLS 2054; thence North 89 degrees 39 minutes 14 seconds West 56.38 feet to a 1/2” iron rod with plastic cap stamped PLS 2054; thence North 00 degrees 50 minutes 23 seconds East 304.78 feet to a 1/2” iron rod with plastic cap stamped PLS 2054 on the south line of that land described as the North 680.5 feet of that SE 1/4 SE 1/4; thence North 89 degrees 43 minutes 08 seconds West 515.05 feet along that south line to a 1/2” iron rod with plastic cap stamped PLS 2054 on the accepted west line of that SE 1/4 SE 1/4; thence South 00 degrees 12 minutes 12 seconds West 304.18 feet along that west line to a 1/2” iron rod with plastic cap stamped PLS 2054; thence South 89 degrees 39 minutes 14 seconds East 176.88 feet to a 1/2” iron rod with plastic cap stamped PLS 2054; thence South 00 degrees 12 minutes 12 minutes West 335.00 feet to a point on the south line of the SE 1/4 of that Section 25 that is South 00 degrees 12 minutes 12 seconds West 40.00 feet from a steel spike survey marker set in bituminous surface; thence South 89 degrees 39 minutes 14 seconds East 387.46 feet along that south line to the point of beginning, containing 6. 582 acres.
Said PROPERTY is improved by a structure commonly known as the DISTRICT’S “High School.” Legal description on District’s title to govern.
Said sale will be made on the following terms, to wit:
1.The Property is to be offered for sale at a public sale by sealed bid to the highest responsible and qualified bidder exceeding the following Reserve Price: $130,000.00. Notwithstanding the foregoing and notwithstanding the establishment of a minimum Reserve Price and/or the receipt of one or more qualified bid meeting or exceeding that minimum Reserve Price, the District reserves the right to reject (with or without cause) any or all bids within FORTY-FIVE (45) days after the sealed bid opening date, in which event the sealed bid public sale shall be of no force or effect and in which event no right for specific performance shall exist against the District.
2.The Property shall be sold “as is-where is” by Quit Claim Deed, legal description on District’s title to govern. The District makes no representations or warranties with respect to the condition or use of said Property, or compliance with environmental laws and regulations. The Purchaser shall be solely responsible for determining the applicability of any laws, local ordinance, or other regulations which may impact the Property and/or the Purchaser’s contemplated use thereof. The Property is being sold subject to any and all rights of the public and any and all easements, covenants and restrictions shown or not shown by public record. Submission of a sealed bid shall serve as that bidder’s acknowledgment that: (a) it has received any and all requested or otherwise required property disclosures prior to the date of bid submission; (b) that it was afforded opportunities to inspect the Property and records relating to its condition before the date of bid submission; and (c) that it has availed itself, to its satisfaction, of the right to inspect the Property and records relating to its condition prior to the date of bid submission; and (d) that it is satisfied with the Property’s condition and that it is taking the Property in AS-IS / WHERE-IS condition. The Property is not believed by District to contain any environmental contamination or other defect.
3.The District will not be responsible for paying any real estate brokers’ commission.
4.By submitting a bid during the public auction, a bidder accepts the terms of the sale as contained herein and in the Board of Education’s Resolution dated December 18, 2013, incorporated herein by this reference as if set out in full, expressly including the terms and provisions of this Notice and the Purchase and Sale Agreement attached to said Resolution. Copies of said Resolution and Purchase and Sale Agreement are available by contacting the District’s Superintendent.
5.District reserves the right to reject any or all bids tendered, to waive irregularities, or to cancel or reschedule the auction.
6.If the District accepts the highest responsive and responsible qualified bid received at public auction by affirmative vote by the Board of Education occurring subsequent to the public sale’s bid opening, the approved and selected successful bidder shall immediately execute the Purchase and Sale Agreement with the District subject to the terms and conditions as set forth in the Board of Education’s Resolution dated December 18, 2013, and this Notice of Public Sale.
7.The closing date on any resulting sale shall be scheduled for June 23, 2014, unless District and the selected bidder agree to alternate closing arrangements. If the selected bidder fails to pay the balance due upon closing, the Bid Deposit and Earnest Money paid shall be forfeited and retained by District as liquidated damages and District may resell the Property. Possession shall be delivered to Buyer at closing.
8.The District may request assurances and proof satisfactory to the District of the bidders’ ability to purchase the property. Failure of the bidder to produce same, to District’s satisfaction as measured solely by District, will permit District to terminate sale to said bidder.
9.The Property will be available for inspection, upon District’s receipt of reasonable written request, prior to the auction date.
10.All bids shall be in writing and presented to the District’s Superintendent on or before the bid deadline at January 29, 2014 and addressed as follows: Kenny Schwengel, Supt, 222 W. Magnolia, Atwood, IL 61913. Bids for this PROPERTY shall be submitted in a sealed envelope, shall contain the bidder’s name and contact information, shall contain the bidder’s bid amount, and shall include a “Bid Deposit” Cashier’s Check or Money Order in the amount of $13,000.00 (10% of the Reserve Price) payable to Atwood-Hammond Community Unit School District No. 39. All sealed bid envelopes relating to this bid shall be marked on the outside: “BID FOR PARCEL ONE IMPROVED WITH HIGH SCHOOL.”
11.The high bidder’s Bid Deposit shall be retained by the District pending Board consideration of the bid and potential sale and closing. Bid Deposits for all other bidders shall be returned by the Superintendent to the bidders within 14 days of the bid opening.
12.If the Board of Education accepts the high bidder’s bid and approves the Property sale pursuant thereto, the Superintendent will notify the high bidder, accordingly, and shall require the high bidder (a) to execute the Purchase and Sale Agreement attached to the Board of Education’s Resolution dated December 18, 2013; and (b) tender additional Earnest Money (if any) required thereunder. The high bidder’s failure to so proceed shall result in the forfeiture of its Bid Deposit.

PLEASE TAKE NOTICE THAT the Board of Trustees for the Village of Rossville will receive sealed bids for the purchase, under the successful bid, of the fee simple interest in the following property:
As part of the Northwest Quarter of the Northwest Quarter of Section 13 and all that part of the North Half of the Northeast Quarter of Section 14, lying East of the Chicago and Vincennes Wagon Road, now known as Dixie Highway, all in Township 22 North, Range 12 West of the 2nd P. M., bounded and described as follows: Beginning at a point in the center line of Dixie Highway is 200 feet North, as measured along said centerline, from the intersection of said centerline with the South line of the North Half of the Northeast Quarter of said Section 14; thence Easterly to a point that is 226 feet East in 200 feet North of the point of intersection of the centerline of the Dixie Highway with the South line of the North Half of the Northeast Quarter of said Section 14; thence North 400 feet; thence Westerly to a point on the centerline of the Dixie Highway that is 400 feet North, as measured along said centerline from the place of beginning; thence Southerly along the centerline of Dixie Highway, 400 feet to the place of beginning, situated in Vermilion County, Illinois.

A contract may be awarded to the highest bidder whose bid is found to be in the best interest of the Village of Rossville. The Board of Trustees reserves the right to reject any and all bids and to waive any informalities or irregularities in the bidding. The Board further reserves the right to review and study any and all bids and to make a contract award within 30 days after the bids have been opened and publicly read.
