IN THE CIRCUIT COURT OF THE SIXTH JUDICIAL CIRCUIT CHAMPAIGN COUNTY, ILLINOIS

In the matter of Minor Sub-District No. 1 Of Sub-District No. 2 Of the Union Drainage District No. 2 Of The Towns Of St. Joseph And Ogden, Champaign County, and State of Illinois. No. 97-MC-43

DRAINAGE NOTICE

PUBLIC NOTICE IS HEREBY GIVEN that on the 20th day of November, 2017, the Commissioners of the above Minor Sub-District (hereinafter referred to as the ‘District’), filed a Petition For Authority To Levy Additional Assessment with the Clerk of the Circuit Court of the Sixth Judicial Circuit, Champaign County, Illinois.

That in their Petition the Commissioners state that the District facilities, the same consisting of sub-surface drainage tile, have deteriorated, broken down, and no longer function as originally intended. That the Commissioners believe that it is necessary that significant work be carried out on said facilities in order that the same properly operate as originally intended. That the Commissioners have determined it will be necessary to assess $310.00 per lot and $10.00 per acre for a total of $92,015.03 to complete the repairs. That the authorized annual maintenance assessment in the District is insufficient to accumulate the necessary funds on an annual basis to complete the necessary repairs. That as such, the Commissioners request that this Court approve an additional assessment and grant permission and authority to borrow from the Longview State Bank the full amount of said assessment at interest payable over six years in order to minimize the burden on the respective landowners, with said additional assessment and interest totaling $92,015.03, as indicated above. A copy of the proposed additional assessment roll for the above indicated amount has been filed with the petition and the Commissioners seek approval of the same. The Commissioners further seek approval of the current financial report which accompanies the petition. No damages or compensation are proposed to be allowed.

Upon filing of the Petition, the same was presented to the Court, and by the Court set for hearing in Circuit Courtroom D, located at the Champaign County Courthouse, 101 E.
