Man faces up to 30 years for spitting on officer
URBANA -- A Champaign man convicted of aggravated battery for spitting on a correctional officer faces up to 30 years in prison.
Emmanuel Chapple's prior convictions for delivery of a controlled substance and possession with intent to deliver a controlled substance make him eligible for sentencing as a Class X felon, meaning he has to be sentenced to between six and 30 years.
A jury deliberated about 25 minutes Tuesday morning before finding him guilty in connection with a Jan. 14 incident at the downtown jail.
Chapple, 25, whose last known address was in the 300 block of East Park Avenue, was being held in the Champaign County Jail on unrelated charges of aggravated criminal sexual assault, robbery and unlawful restraint for a Jan. 10 incident in which he allegedly robbed and raped a woman he knew in Champaign, then refused to let her leave her home.
Those charges remain unresolved and are expected to be addressed May 25 when Chapple is sentenced by Judge Tom Difanis for the aggravated battery.
In the aggravated battery, he was found to have spit on correctional officer Craig Wakefield through the talk hole of a cell door as Wakefield escorted aonother inmate from one part of the downtown jail to another.
Whatever sentence Chapple receives for that will have to be served consecutive to any sentence he might receive if convicted of the charges in the sex assault case.
