August trial set on charges in Alvin shooting

DANVILLE — A 39-year-old Kentucky man will stand trial for attempted murder and home invasion in connection with a March shooting in Alvin.

Vermilion County Circuit Judge Nancy Fahey on Thursday found probable cause to try Jason A. Irwin of Albany, Ky., on one count of attempted murder and three counts of home invasion, all Class X felonies.

Irwin's jury trial was scheduled for Aug. 12.

Irwin is accused of breaking into a house in the 100 block of South Street in Alvin just before 4 a.m. on March 27, and shooting the homeowner, Michael Reffett Jr., multiple times. Reffett's girlfriend, Tess Haga, also was in the house at the time, but she was not injured.

At Irwin's preliminary hearing, Sgt. Bill Hurt of the Vermilion County Sheriff's Department testified that he interviewed Reffett at Carle Foundation Hospital in Urbana, where he was being treated for gunshot wounds.

Reffett said that he, Irwin and Haga, who had previously dated Irwin, had had a problem earlier in the evening. He said they had been at the American Legion in Rossville, where Irwin confronted Haga.

"He had made a statement that he was going to shoot her," Hurt said.

That night, Reffett reported, Irwin had called Haga 15 times between midnight and 3:54 a.m. Around the time of the last call, Reffett heard a vehicle pulling into his driveway. When he went to the door, he saw Irwin walking to the side of his house.

Hurt said Reffett reported getting a shotgun, then hearing a noise coming from his back porch. When he saw Irwin inside, he started to order him out of his home. But before he could finish, he was shot three times by Irwin.

Hurt said that Reffett returned fire, missing the intruder the first time. When he fired again, the man went down by the stairwell.

Hurt said a deputy arrived at the house at 4:10 a.m. He said the deputy found Reffett standing in the kitchen bleeding profusely from the groin, and Irwin lying on the floor near the living room-dining room area.

Hurt also said the deputy retrieved a .45-caliber handgun and another one in Irwin's pocket. After searching the house, deputies also recovered the shotgun, spare magazines, shell casings and live rounds that were all taken into evidence.

Hurt testified that Reffett suffered multiple gunshot wounds to the groin area, arm and hip. He said Irwin suffered gunshot wounds in the right arm and chest. He added when he tried to interview Irwin at the hospital, the man requested an attorney.

Both men were taken to Provena United Samaritans Medical Center in Danville and later airlifted to Carle. Irwin remained hospitalized until May 20, and was taken into custody upon his release.

He remains in the Vermilion County Jail in lieu of a $250,000 bond, meaning he would have to post $25,000 to be released.
