Man gets 35 years for killing his brother in Tolono

URBANA — A Savoy man who admitted he fatally shot his brother a year ago has been sentenced to 35 years in prison.

Brian Maggio, 43, pleaded guilty in June to the first-degree murder of his brother, Mark Maggio, 32, of Tolono.

The shooting occurred at the now-closed Tolono IGA on Main Street about noon on July 21, 2010.

Assistant State's Attorney Adam Dill said the brothers, who at one time both ran the store, did not get along and that financial problems apparently fueled their ill will toward each other.

Mark Maggio, who ran the Arcola IGA store, had gone in the Tolono store that day to speak to the manager while his brother was out.

Dill said witnesses reported that Brian Maggio returned while Mark Maggio was there, made disparaging remarks to him and pushed his younger brother, resulting in both of them falling. As Mark Maggio got up to run toward the exit, his brother fired one shot that entered his chest. He died just inside the door to the store.

Champaign County Judge Heidi Ladd imposed the sentence on Maggio, who had no prior convictions.

Dill had sought a sentence of 35 years while Maggio's attorney, Dan Jackson of Champaign, asked for 25.

Maggio will have to serve 100 percent of the sentence. He was given credit for the year he's already served.

Had he been convicted of all the murder counts, Maggio could have received life in prison, but Dill agreed at the time Maggio pleaded guilty to cap his recommendation at 35 years.
