Armed robbery charges dismissed

URBANA — Armed robbery charges have been dismissed against two men after their alleged victim recanted his story.

Assistant Champaign County State's Attorney Adam Dill said the alleged victim swore in an affidavit that Eric D. Kirk Jr., 25, and Sherrick Cooper, 23, had not robbed him at gunpoint in the 1000 block of South Smith Road on July 27.

The charge against Cooper, who listed an address in the 1300 block of South Lierman Avenue, Urbana, was dismissed Sept. 15 while the charge against Kirk, of the 200 block of South Grove Street, Urbana, was dismissed Tuesday,

A hand-written note in Kirk's file by the alleged victim called the incident a "misunderstanding."

A second count in that same case accused Kirk of unlawful possession of weapon by a felon alleging he had a gun on Sept. 1.

Kirk, however, was resentenced Tuesday to 90 days in jail for a 2010 domestic battery conviction. He admitted he violated the probation he received last October for that offense by failing to report to a probation officer. He was given credit for 47 days already served.
