Men charged over incidents on campus
URBANA — Champaign police continue to investigate incidents at a Campustown restaurant last week involving two male employees who allegedly came into the restroom while female patrons were using the toilet.
The men were criminally charged Monday in Champaign County Circuit Court, one with four felony offenses after he allegedly touched one woman, and the other with a misdemeanor for scaring a different woman.
Assistant State's Attorney Steve Ziegler said Samuel Garcia-Quintania, 24, who listed an address in the 100 block of East Springfield Avenue, was charged with criminal sexual assault, aggravated criminal sexual abuse, aggravated battery and unlawful restraint.
He's being held in the county jail in lieu of $50,000 bond and is due back in court next week.
Ziegler said Garcia-Quintania was working at Geovantis, 401 E. Green St., about 3 a.m. Saturday when a 19-year-old University of Illinois student was in line to use the women's restroom.
According to a Champaign police report, Garcia-Quintania told the woman there was no one in line for the men's room and that she could use it and he would watch the door for her.
"The next thing she knows she hears somebody come in. He pushes the stall door open, walks in and won't let her out," said Ziegler.
The prosecutor said Garcia-Quintania allegedly put his hands down her underwear.
The woman immediately reported the contact to police, who arrested Garcia-Quintania at the business.
While police were there, the manager told them he had learned of a similar incident that occurred late Thursday night at the restaurant, and got the woman involved to come in while police were there Saturday.
After hearing from that woman, police arrested Eleazar Garcia-Quintana, 20, for disorderly conduct. He is also a Geovantis employee who shares the same apartment with Samuel Garcia-Quintania, according to court records.
According to the report about the Thursday incident, the woman, a 20-year-old UI student, was in line to use the women's bathroom about 11:20 p.m. when Eleazar Garcia-Quintana approached and told her she could use the men's bathroom, which had no line. She asked him to watch the door because she knew it didn't lock.
Once she sat down to use the toilet, he reportedly walked in, opened his arms and said "Can't I just get some love?" The woman pulled up her pants and told him his behavior was wrong.
In that case, Garcia-Quintana did not touch the woman, the report said.
Champaign police Sgt. Bruce Ramseyer, who responded to the call early Saturday, said he was told the men are brothers but is not certain as they didn't have identification. As to the different spellings of their last names, Ramseyer said police had to rely on what the men told them during arrest because of the lack of identification or Social Security numbers.
Eleazar Garcia-Quintana was arraigned on the Class A misdemeanor disorderly conduct Monday and was told to be back in court Nov. 30. He remains free on bond.
Ramseyer said both young women had been at the restaurant and bar before and were very upset about what had happened. He said the bathroom they were using is on a separate floor from the bar and is next to the kitchen where the men worked.
