Teen sentenced to 20 years for injuring Atwood man

TUSCOLA — A Champaign teen who admitted severely injuring an Atwood man in a fight more than a year ago has been sentenced to 20 years in prison.

Douglas County Judge Mike Carroll imposed the sentence Wednesday that Zakary Giannetti's lawyer, Douglas County Public Defender Jim Lee, and Douglas County State's Attorney Kevin Nolan had agreed to.

Giannetti, 18, whose last known address was in the 2000 block of Broadmoor Drive, pleaded guilty in October to armed violence in connection with an October 2010 incident that Nolan said resulted in "life-altering injuries" to Danny Fischer, 31, of Atwood.

On Oct. 10, 2010, Giannetti wounded Fischer in a fight in the parking lot of the Hillside Manor Apartments in Atwood. Nolan said there was apparently antagonism between the two men, whose girlfriends were friends.

"How this fight erupted still doesn't make sense to me," said the prosecutor, who added that during the fight Fischer's head was stomped, causing him brain injuries.

"He is out of the nursing home and at his mother's home being tended to by family and a close friend," said Nolan, who added that Fischer was in need of a feeding tube for months in the nursing facility. "He's gotten far better than I thought he would."

Nolan said he and Lee agreed to the 20-year sentence. Because of the great bodily harm to Fischer, Giannetti will have to serve 85 percent or 17 years. He's already served a year and three months.

Nolan said he also agreed not to file any additional charges against Giannetti for a Nov. 15 incident at the Douglas County jail in which the teen allegedly jabbed at a fellow inmate with a pen. That man was not seriously injured.

Nolan said Giannetti had prior adjudications as a juvenile from Champaign County.
