Accused rejects plea deal in Ford County case

PAXTON — A man awaiting trial for second-degree murder has rejected a second plea offer from Ford County State's Attorney Matt Fitton.

During a pretrial hearing Monday, Fitton offered a sentence of no longer than 14 years in prison to Ryan A. Nibbe if he agrees to plead guilty to second-degree murder, a Class 1 felony.

"I don't want that deal," Nibbe told his court-appointed attorney, David Rumley.

Rumley announced earlier that the case was ready for trial, and he would be filing an answer to discovery provided by Fitton. Rumley added that he had received the autopsy report he requested from Fitton.

Judge Steve Pacey set Nibbe's trial for Jan. 14.

Nibbe, 34, whose last known address was in Gibson City, is charged with one count of second-degree murder and two counts of felony battery in connection with a July 28 altercation outside an apartment building in Gibson City.

Nibbe is accused of punching Timothy Robertson, 44, of Gibson City in the head. Mr. Robertson later died from head trauma.

In September, Fitton had offered to dismiss two counts of felony battery in return for a guilty plea to second-degree murder. Unlike the newest plea offer, the first one did not specify a maximum prison term.

Under truth-in-sentencing sentencing guidelines, Nibbe faces a mandatory prison term ranging from four to 20 years in prison and three years of mandatory supervised release if he is convicted.

Nibbe remains jailed on $400,000 bond.

Nibbe was paroled in February after being sentenced to two years in prison in April 2012 for an aggravated battery conviction in Macon County.
