URBANA — A Champaign man who participated in the holdup of a Champaign fast-food restaurant more than a year ago was sentenced Friday to four years in prison.
Champaign County Judge Heidi Ladd gave Xavier Gary, 22, of the 200 block of East Garwood Street credit for a year and two weeks he’s already served in the county jail.
Gary pleaded guilty in December to aggravated robbery for being the look-out for Larry D. Pettigrew, 24, of Champaign, who admitted that on Dec. 28, 2012, he went in the Hardee’s at 1806 W. Bradley Ave., C, and brandished what appeared to be a weapon to get cash from the business.
Pettigrew, who’s currently serving an eight-year prison term for aggravated robbery, was caught nearby but Gary fled and was arrested about two weeks later.
Gary apologized to Judge Heidi Ladd, saying he was drunk and under the influence of cannabis when he took part in the holdup. His only prior legal case was a criminal damage to property for which he received court supervision.
Ladd said in spite of Gary’s minimal criminal record and his scattered work history, she was “troubled” by the “planning aspect” of the crime.
