Tolono amends liquor law

TOLONO — After a veto on an earlier version, Tolono has again amended its definition of a restaurant liquor license.

Village President Kent Plackett vetoed the village board's Nov. 1 approval of a revised version of the Class B license that would have allowed package liquor to be sold at restaurants. That version of the license would have prevented anyone under age 19 from entering a restaurant after 10 p.m. without a parent or legal guardian, a restriction intended to keep a restaurant from relying too much on liquor sales.

"In my mind, it's backward," Plackett said. "They could say, 'At 9, we do what we want.'"

The ordinance change came after businessman Gignesh Banchel told the board that he wanted to open a restaurant with a bar and to sell package liquor at the former Radmaker's. The village did not have a liquor license allowing a business to have all three components.

On Tuesday, Trustee Mike Golish suggested relegating package liquor sales to a separate license and removing a section of the liquor ordinance that limited license holders to one license. In addition, Golish proposed deleting the age restriction on customers entering after 10 p.m. and lowering the annual restaurant license fee from $750 to $450.

If a restaurant owner wants to sell package liquor, it will require an additional $450 license.

The board approved the new ordinance amending the restaurant license definition by a vote of 4-2, with Trustees Greg Kingston and Jeff Revell opposing it. Kingston said he still had concerns about the viability of Gignesh's business plan.
