URBANA — A Fisher man who allegedly forced a teenage girl to have sex with him, hours after having been released from jail for a similar offense, has been arrested again.
Cody Drinkwalter, 20, was charged Friday in Champaign County Circuit Court with aggravated criminal sexual abuse for allegedly having sex with a 13-year-old girl in rural Mahomet against her will on July 25.
State's Attorney Julia Rietz said Drinkwalter had been charged last week in a separate case with aggravated criminal sexual abuse for allegedly engaging in a sex act with a 14-year-old girl in Fisher on July 11. He had reportedly been dating that girl.
Drinkwalter posted bond to be released from jail on the afternoon of July 25 and was told to be back in court Sept. 16.
Hours later, according to a Champaign County sheriff's report, Drinkwalter took a 13-year-old girl and two friends to a bonfire at a house in rural Mahomet.
Rietz said he and the teen had known each other about six months. They ended up alone in the house, where he took her to a bedroom and allegedly had sex with her. The girl told sheriff's investigators she had protested to Drinkwalter. Once home, she reported what had happened to her mother, who contacted authorities.
Sheriff's Lt. Curt Apperson said his detectives began investigating on Tuesday and on Thursday had enough information to arrest Drinkwalter.
Aggravated criminal sexual abuse is a Class 2 felony carrying penalties ranging from probation to three to seven years in prison.
If convicted in both cases, Drinkwalter would have to serve the sentences one after the other because the second incident occurred while he was out on bond in the first.
