URBANA — The driver of an all-terrain vehicle whose cousin died as a result of a crash on Sunday was allegedly driving while drunk.

Katheryn J. Daly, 24, of the 200 block of East Jefferson in Philo, was issued two tickets for misdemeanor driving under the influence of alcohol and one for failure to reduce speed to avoid an accident in connection with the Oct. 6 crash that killed Annie Daly, 19, of Philo.

Champaign County sheriff's Lt. Brian Mennenga said deputies learned that just about 3 a.m. Sunday, Katheryn Daly was driving a John Deere Gator south on County Road 1700 E and was about to turn east on to 600 N when she skidded over wet gravel in the intersection and left the road. The Gator then rolled on to its side.

When the Gator was lifted, Annie Daly was off to the side of the ATV, still conscious, he said.

Mennenga, who identified the two women as cousins, said Katheryn Daly admitted that she had been drinking earlier at a relative's house. She failed field sobriety tests. She was taken to the county jail, where a breath test put her blood-alcohol concentration at 0.13 percent, over the 0.08 percent for an Illinois motorist to be presumed intoxicated.

Mennenga said Katheryn Daly was not taken to the hospital for a blood draw because deputies did not realize at the time how gravely injured Annie Daly was. She died at 6:24 a.m. at Carle Foundation Hospital of her injuries.

Katheryn Daly was released from jail after posting bond and ordered to appear in court on Nov. 8.
